Terms and Conditions

Welcome to EasyWave.

These Terms and Conditions govern your access to and use of the EasyWave mobile application, the easywave.co.za website, and any related EasyWave services, features or content.

Please read these Terms carefully.

By accessing, creating an account on, or using EasyWave, you agree to these Terms.

If you do not agree to these Terms, you should not use EasyWave.


1. About EasyWave

EasyWave is a location-based community and local-business discovery platform.

EasyWave helps users discover nearby:

  • Community groups
  • Local businesses
  • Community posts
  • Events
  • Local announcements
  • Promotions
  • Billboards
  • Other locally relevant content

EasyWave primarily uses a user’s location to determine which content is relevant within approximately a 10 kilometre radius.

EasyWave is currently available on Android.

An iOS version is planned for the future.

3. Acceptance of These Terms

By using EasyWave, you confirm that:

  • You have read these Terms;
  • You understand these Terms;
  • You agree to comply with them; and
  • You have the legal capacity required to use the service or any necessary permission from a parent, guardian or other legally authorised person.

These Terms apply to all EasyWave users, including:

  • Ordinary users
  • Group members
  • Group administrators
  • Group owners
  • Business owners
  • Business representatives
  • Visitors to the EasyWave website

4. Your EasyWave Account

Certain EasyWave features may require an account.

When creating or using an account, you must provide information that is accurate and reasonably current.

You are responsible for maintaining the confidentiality and security of your account.

You must not:

  • Allow another person to misuse your account;
  • Attempt to access another user’s account without permission;
  • Create accounts for fraudulent or abusive purposes;
  • Impersonate another person or organisation;
  • Misrepresent your identity or authority.

If you believe your account has been compromised, you should contact EasyWave as soon as reasonably possible.


5. Authentication

EasyWave may use third-party authentication infrastructure, including services such as Firebase Authentication.

You are responsible for maintaining access to the email address or authentication method associated with your EasyWave account.

EasyWave may require additional verification where reasonably necessary for security purposes.


6. Location Services

Location is a core part of EasyWave.

If you grant EasyWave location permission, EasyWave may use your device’s geographic location to determine which groups, businesses and other local content are near you.

EasyWave generally focuses local discovery within approximately a 10 km radius.

The exact content shown may vary based on:

  • Your location
  • Availability of content
  • Business or group locations
  • Technical accuracy
  • Location permissions
  • Device settings
  • Network availability

EasyWave does not guarantee that every relevant business, group or event within 10 km will appear.

Similarly, the appearance of a business or community in EasyWave does not guarantee that it is physically located at the exact distance or position displayed.

GPS and other positioning technologies may occasionally be inaccurate.


7. Location Privacy

EasyWave does not intend to publicly display an ordinary user’s exact GPS coordinates merely because they use the service.

You may, however, intentionally publish location-related information through certain features.

Examples include:

  • A business address
  • An event location
  • A location included in a community post

You are responsible for considering what location information you choose to publish publicly.

Further details are contained in the EasyWave Privacy Policy.


8. Community Groups

EasyWave allows users to create, discover and participate in community groups.

Groups may be configured differently.

Depending on the group, posting may be:

  • Open to members;
  • Restricted to administrators; or
  • Subject to administrator approval.

Group owners and administrators may establish additional community rules provided those rules do not conflict with these Terms or applicable law.

EasyWave does not necessarily review or approve every group, post or comment before it appears.


9. Group Administrators

Group administrators may have the ability to:

  • Approve or reject posts
  • Remove content
  • Manage membership
  • Review reports
  • Remove members
  • Establish group rules
  • Pin important content
  • Moderate discussions

Group administrators must exercise these powers responsibly and may not use administrative access to harass, discriminate unlawfully against, threaten or exploit other users.

EasyWave may intervene in a group where necessary to enforce these Terms, protect users or comply with law.


10. User Content

EasyWave allows users to submit content.

This may include:

  • Text
  • Posts
  • Comments
  • Images
  • Videos
  • Documents
  • Reviews
  • Recommendations
  • Business information
  • Events
  • Promotions
  • Group content
  • Other material

You retain ownership of content that you create, subject to the rights you grant EasyWave under these Terms.


11. Licence to Use Your Content

By uploading or publishing content through EasyWave, you grant EasyWave a non-exclusive licence to host, store, reproduce, display, process and distribute that content to the extent reasonably necessary to operate EasyWave.

For example, this licence allows EasyWave to:

  • Store your post on its servers;
  • Display your post to community members;
  • Create resized versions of uploaded images;
  • Deliver media through content infrastructure;
  • Display your business information to nearby users;
  • Back up information;
  • Moderate or investigate reported content.

The licence exists only to the extent reasonably required to provide, operate, secure and improve the EasyWave service.

You remain responsible for ensuring you have the necessary rights to upload the content.


12. Content You Must Not Upload

You must not use EasyWave to publish, distribute or promote content that:

  • Is illegal;
  • Is fraudulent;
  • Is deliberately deceptive;
  • Threatens or encourages violence;
  • Harasses or unlawfully discriminates against others;
  • Infringes intellectual property rights;
  • Violates another person’s privacy;
  • Contains malicious software;
  • Facilitates scams or fraud;
  • Falsely impersonates another person or business;
  • Promotes illegal goods or services;
  • Exploits or endangers children;
  • Contains unlawful intimate or sexual material;
  • Encourages criminal conduct;
  • Intentionally interferes with EasyWave’s operation.

EasyWave may remove content that violates these Terms.


13. Community Conduct

Users are expected to interact respectfully and responsibly.

Disagreement is allowed.

Criticism is allowed.

Negative business reviews are allowed where they reflect genuine opinions or experiences.

However, users may not use EasyWave to:

  • Threaten people;
  • Coordinate harassment;
  • Repeatedly target another user;
  • Publish knowingly false allegations as fact;
  • Spam communities;
  • Manipulate engagement;
  • Create fraudulent reviews;
  • Intentionally disrupt groups;
  • Circumvent moderation measures.

14. Reviews and Recommendations

Reviews and recommendations on EasyWave may be created by users.

Unless explicitly stated otherwise, these represent the views of the individual users who submitted them.

EasyWave does not guarantee that:

  • A review is accurate;
  • A reviewer has the same expectations as you;
  • A business will provide the same experience to every customer;
  • A recommendation is suitable for your circumstances.

Businesses may report reviews that they reasonably believe violate these Terms.

EasyWave may investigate reports but is not required to remove a review merely because a business disagrees with it.


15. Business Profiles

Businesses may create or manage profiles on EasyWave.

Businesses are responsible for ensuring that information they publish is accurate and lawful.

This may include:

  • Business name
  • Address
  • Opening hours
  • Contact details
  • Pricing
  • Product information
  • Service information
  • Promotions
  • Events
  • Images
  • Availability

Businesses must not intentionally publish misleading or deceptive information.


16. EasyWave Is Not the Business

Unless EasyWave expressly states otherwise, EasyWave does not itself provide the products or services advertised by third-party businesses on the platform.

A business listing on EasyWave does not mean that EasyWave:

  • Owns the business;
  • Operates the business;
  • Employs its staff;
  • Guarantees its services;
  • Endorses every claim made by the business.

Any transaction between a user and a third-party business is generally between those parties.

The business remains responsible for complying with applicable consumer, tax, licensing, safety and other legal requirements.


17. Business Verification

EasyWave may introduce verification measures for businesses or organisations.

However, the presence of a business profile does not automatically mean that EasyWave has independently verified every detail supplied by the business.

Users should exercise reasonable judgement when dealing with businesses discovered through EasyWave.


18. Events

Event information may be submitted by users, businesses or community administrators.

EasyWave does not guarantee:

  • That an event will take place;
  • That event details are accurate;
  • That tickets remain available;
  • That organisers will honour advertised arrangements;
  • That an event is suitable or safe for a particular user.

Users should confirm important event details directly with the organiser where appropriate.


19. Billboards and Promotions

EasyWave may display community announcements, promotional content, sponsored content or Billboards.

Sponsored or paid promotional content may be identified as such where appropriate.

Businesses and advertisers are responsible for ensuring their advertising complies with applicable law.


20. Third-Party Services and Links

EasyWave may contain links to or integrations with third-party services.

Examples may include:

  • Websites
  • WhatsApp
  • Google Maps
  • Social media
  • Booking services
  • Payment providers
  • External business websites

EasyWave does not control these third-party services.

When you access an external service, that provider’s own terms and privacy practices apply.

EasyWave is not responsible for the content or operation of third-party websites merely because a link appears on EasyWave.


21. Availability of the Service

EasyWave aims to provide a reliable service but does not guarantee uninterrupted availability.

The platform may occasionally be unavailable because of:

  • Maintenance
  • Software updates
  • Infrastructure failures
  • Internet outages
  • Third-party service interruptions
  • Security incidents
  • Technical faults
  • Circumstances outside EasyWave’s reasonable control

EasyWave may modify or temporarily suspend parts of the service where reasonably necessary.


22. Offline Features

Some EasyWave information may be cached on your device for offline use.

Offline information may not reflect the latest version available on EasyWave’s servers.

Actions requiring server verification or synchronisation may require an active internet connection.


23. Changes to EasyWave

EasyWave is an evolving platform.

Features may be:

  • Added
  • Changed
  • Replaced
  • Removed
  • Redesigned
  • Temporarily disabled

EasyWave may make reasonable changes to improve usability, security, performance or functionality.

Where a material change affects a paid service or legal right, EasyWave will provide notice where required by law.


24. Android and iOS Availability

EasyWave is currently available on Android.

References to an upcoming iOS application do not constitute a guarantee that the iOS application will launch on a particular date.

Release dates and platform availability may change.


25. Updates to the Mobile App

From time to time EasyWave may release application updates.

Some updates may be required for:

  • Security
  • Compatibility
  • New features
  • Bug fixes
  • Continued access to the service

Older versions of the application may eventually stop functioning correctly or may no longer be supported.


26. Intellectual Property

Except for user-generated content and third-party material, EasyWave and its associated materials are protected by applicable intellectual-property law.

This may include:

  • EasyWave branding
  • Logos
  • Interface designs
  • Software
  • Source code
  • Graphics
  • Text
  • Website design
  • Databases
  • Product names

You may not copy, reproduce, reverse engineer, sell, distribute or commercially exploit EasyWave intellectual property without permission, except where the law expressly permits it.


27. EasyWave Brand

The EasyWave name and logo may not be used in a manner that falsely suggests:

  • Partnership
  • Sponsorship
  • Approval
  • Ownership
  • Official representation

unless EasyWave has authorised such use.


28. Reporting Content

Users may report content or behaviour that appears to violate these Terms.

Reports should be made honestly and in good faith.

Knowingly submitting false or abusive reports may itself constitute misuse of the platform.

EasyWave may investigate a report and determine what action is reasonably appropriate.


29. Content Moderation

EasyWave may take moderation action where reasonably necessary.

Actions may include:

  • Removing content
  • Limiting visibility
  • Issuing warnings
  • Restricting posting
  • Suspending accounts
  • Removing users from groups
  • Disabling business profiles
  • Terminating accounts

EasyWave may consider factors such as:

  • Severity
  • Context
  • Previous violations
  • Risk to other users
  • Applicable law

Where appropriate and technically feasible, EasyWave may provide users with information regarding significant moderation action.


30. Account Suspension and Termination

EasyWave may suspend or terminate an account where reasonably necessary because of:

  • Serious violations of these Terms;
  • Repeated violations;
  • Fraud;
  • Abuse;
  • Security risks;
  • Illegal activity;
  • Attempts to compromise EasyWave systems;
  • Legal requirements.

Where appropriate, EasyWave may first provide a warning or temporary restriction.

Immediate action may be taken where reasonably necessary to prevent harm, fraud, unlawful activity or security threats.


31. Closing Your Account

You may stop using EasyWave at any time.

Where available, you may request account deletion through the application or by contacting EasyWave.

Deletion of personal information is handled in accordance with the EasyWave Privacy Policy and applicable law.


32. Privacy

Your use of EasyWave is also governed by the EasyWave Privacy Policy.

The Privacy Policy explains matters including:

  • What personal information EasyWave collects;
  • How location information is used;
  • How information is protected;
  • How information may be shared;
  • Your privacy rights.

The Privacy Policy forms part of EasyWave’s overall relationship with users but should be read as a separate document.


33. Security

You must not attempt to:

  • Circumvent authentication;
  • Access data without authorisation;
  • Probe EasyWave infrastructure for vulnerabilities without permission;
  • Introduce malware;
  • Interfere with service availability;
  • Abuse APIs;
  • Scrape EasyWave excessively;
  • Circumvent rate limits;
  • Reverse engineer protected systems except where expressly allowed by law.

Security vulnerabilities should be reported responsibly to EasyWave.


34. No Guarantee of Local Content

EasyWave depends on communities and businesses participating in the platform.

Accordingly, EasyWave cannot guarantee that a particular location will have:

  • A specific number of users;
  • Active groups;
  • Business listings;
  • Events;
  • Posts;
  • Promotions.

Some areas may have significantly more EasyWave activity than others.


35. Information Is Provided for General Use

Information available through EasyWave is intended primarily for community and discovery purposes.

EasyWave does not guarantee that user-generated information is complete, accurate or current.

Where information is important to your safety, finances, legal rights, health or another high-impact decision, you should independently verify it with an appropriate authoritative source or professional.


36. Consumer Rights

Nothing in these Terms is intended to exclude, limit or waive a right that cannot lawfully be excluded under South African law.

Where the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002, or another applicable law grants you rights that conflict with these Terms, the applicable statutory right will prevail.


37. Disclaimer

To the fullest extent permitted by applicable law, EasyWave is provided on a reasonable-efforts basis.

EasyWave does not warrant that:

  • Every feature will always be available;
  • User-generated content will always be accurate;
  • Businesses will always honour information posted on their profiles;
  • Location results will always be precise;
  • The service will never contain technical errors.

This clause does not limit rights or remedies that cannot lawfully be excluded.


38. Limitation of Liability

To the fullest extent permitted by applicable law, EasyWave will not be responsible for indirect or consequential loss arising solely from:

  • Reliance on inaccurate third-party content;
  • Transactions between users and independent businesses;
  • Unauthorised third-party conduct;
  • Temporary technical outages;
  • Third-party services outside EasyWave’s reasonable control.

Nothing in these Terms excludes liability where exclusion is prohibited by law.

In particular, nothing is intended to exclude liability or statutory remedies in circumstances where South African consumer law prohibits such exclusion.


39. Your Responsibility

You are responsible for:

  • Your use of EasyWave;
  • Content you publish;
  • Your interactions with other users;
  • Transactions you choose to enter into with businesses;
  • Protecting your account;
  • Verifying information where reasonably necessary.

You must use the service lawfully and responsibly.


40. Paid Features

EasyWave may introduce paid features, subscriptions, advertising tools or premium business services in the future.

Before completing a paid transaction, users will be provided with relevant information such as:

  • Price
  • Billing frequency
  • Applicable taxes or charges
  • Payment method
  • Cancellation information
  • Material conditions applying to the purchase

Additional payment or subscription terms may apply.

Where such terms conflict with these Terms regarding a specific paid service, the more specific terms will apply to that service.


41. Refunds and Cancellation

Any refund or cancellation rights relating to paid EasyWave services will be provided in accordance with:

  • Applicable South African law;
  • The terms presented at the time of purchase; and
  • Where applicable, the policies of the relevant app store or payment provider.

EasyWave will not use these Terms to remove a statutory cooling-off, cancellation or refund right that applies by law.


42. Google Play

Where EasyWave is downloaded through Google Play, your use of Google Play is also subject to Google’s applicable terms.

Google is not responsible for operating EasyWave merely because EasyWave is distributed through Google Play.

Payments processed through Google Play may also be subject to Google’s payment and refund rules.


43. Advertising

EasyWave may display advertisements, promoted listings or sponsored content.

Advertising does not necessarily constitute an endorsement by EasyWave of the advertiser or its products.

Advertisers are responsible for the accuracy and legality of their advertisements.


44. Changes to These Terms

EasyWave may update these Terms from time to time.

Changes may be necessary because of:

  • New features;
  • Legal developments;
  • Changes to EasyWave services;
  • Security requirements;
  • Business changes.

The Last updated date will be changed when the Terms are updated.

Where a change is material, EasyWave may provide additional notice through the app, website, email or another appropriate method.

Continued use after updated Terms take effect constitutes acceptance to the extent permitted by law.


45. Governing Law

These Terms are governed by the laws of the Republic of South Africa.

Nothing in this clause prevents a consumer from using any court, regulator, ombud, commission or other dispute-resolution mechanism that they are entitled to use under applicable law.


46. Disputes

If you have a dispute with EasyWave, you are encouraged to contact us first so that the issue can be reviewed.

Where a dispute cannot be resolved directly, either party may exercise any rights available under applicable South African law.

This may include approaching an appropriate court, regulator, consumer body or dispute-resolution forum.


47. Severability

If part of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply to the extent legally possible.

The affected provision should be interpreted or limited only to the extent necessary to make it lawful.


48. No Waiver

If EasyWave does not immediately enforce a provision of these Terms, this does not automatically mean EasyWave has waived the right to enforce it later.


49. Entire Agreement

These Terms, together with the EasyWave Privacy Policy and any additional terms that expressly apply to a particular feature or paid service, constitute the agreement governing your use of EasyWave.

Nothing in this clause excludes representations or rights that cannot lawfully be excluded.
